2 Legacy gameplay bug?

1) mining probe still deploys with only build constructor

2) when fighting Vonari in war zone: capital ship of opposite faction fires at player (shouldn't that be suspended like with the smaller ships?)

For 1, fixed for the next update. For 2, no, capital ships may still attack you in war zones if you are of an opposing faction. If you catch one green, then it won't. But it's not always a guarantee that such ships of the opposing faction will leave you alone in war zones.
