That was very helpful. I never new about the term fair use.
When I was using the same type of textures for some new backgrounds for Evochron Mercenary 1.x, I was informed that that the owner of these textures probably would't mind that I've used them since they also released their ship models to download.
So I contacted them to ask if they are ok about using their textures for Evochron.
I'm hoping for an answer soon.

Dear community,
Previous months a lot has happened, I bought a house, changed jobs etc. and I didn't find the time to completely finish the mod until a week ago.
A couple of hours ago, my intentions were to finally release the mod under "fair use".
Soon after, some people of the community warned me again about using copyrighted material and I got spooked...
And I actually never got an answer of the copyright owner if it was ok to use their material.
So I'm sorry to inform you guys that I have decided to NOT release this mod because it is not clear to me if I would make a violation or not. I'm just not comfortable with releasing this mod.

Modders usually include a "fair use" notice in the ReadMe instructions for their mods ... where the only requirements often are (1) that the modder be given credit for the work and (2) that the mod be distributed free of charge. A good example is JSGME. If you don't find such a notice in the download or a similar statement by the modder at the corresponding forum or his own download site, then it's a good idea to assume that the mod should only be used for the targeted game.

Coincidentally, since I've been making some fundamental changes to my graphic design business, I've been looking really hard at copyright law and what it really is, and all the different types of licenses available in detail. If it helps, I can tell you the following.
In short, copyright is a legal law which reserves all rights to a creative work for its designer. Anyone who creates anything from scratch, automatically holds the copyrights to that piece. If no other licenses are applied to an original creative (and published) work, then only its original creator holds the rights to the piece.
But there are those who deliberately choose to share their work with no restrictions, or just a few, or under certain conditions. Probably the best example for this are the 'Creative Commons' licenses. They come in different forms, with each type having different conditions and terms. The most 'open minded' version would be the Creative Commons Attribution-ShareAlike 3.0 Unported license.
This would be the type of license you would want to look for, although there are others that allow you to use someone else's work too.
The Creative Commons website offers a load of information regarding the different types of licenses around, and also which license you would want to apply to your own work. It's really worth the time (for anyone) to take a look at the Creative Commons website and licenses some time.

I just have a quick question, do the latest version of nebulae enhenced works with EM 2.X ??
It seems I can't get it working on my computer while the environment pack by 8rennus is working perfectly.
